Typically, SBDC clients have exhausted all of their savings and cannot secure funding as they await settlement of their case. In some instances, clients just don't have the financial means required to present and maintain their cases through all the necessary stages of litigation.

How It Works!

We will fax or email you a Release form so that we may request case file information from your attorney. After you sign the Release and simply fax it back to us at 813-684-1463 or mail it.

We will fax your attorney a questionnaire about your case with a list of documents we need to evaluate your case. These documents include: police report, ambulance report, emergency room report, medical reports, MRI Reports, X-Ray Reports, bills, etc. 

Once we have reviewed the questionnaire and documents from your attorney, we will be able to give you an answer within 24 hours. 

Success By Design Capital does not have control over the management of your case. In fact, we will not participate even if requested. All decisions regarding your case and its resolution are up to you and your attorney.

Closing Procedures
When your case is approved we will FedEx completed but unexecuted documents to your attorney's office.

You must go there to sign and have the documents notarized. Remember to bring your driver's license, as we will want a photocopy of it.

Once the documents have been returned to us, we will FedEx a check to your home or attorney's office.

Our Fees
Each case is unique. Our fees are based on our own independent analysis of the value and risk of your case.

Generally, we charge either a flat fee or take a percentage of the case. In certain cases we use a combination of both.

If your lawsuit/claim/action is unsuccessful you owe us absolutely nothing.
If your case is successful, we will be paid directly by your lawyer out of the proceeds of your settlement.

Q. What are SBDC's requirements for funding?

A. It depends upon the specific facts of your case. Most cases require a police report, medical reports that substantiate the injuries sustained, and other pertinent information. Our legal funding advisers will assist you.


Q. How long does it take to get approval?

A. After we receive the requested documents on your case from your attorney, and discuss the facts of your case with your attorney, generally you will be approved within 48 hours.
From the time we have all the information we need from the clients' attorney, we will have a decision within 24 hours for cases under $5,000 and an additional day or two for investments $5,000 and greater. The reason for the different timelines is that we have every case $5,000 and greater reviewed by our own counsel.


Q. How much of an advance may I request?

A. $1,000 to over $100,000 may be advanced, depending upon our evaluation of your case. Due to the risks involved, this can be more expensive than traditional financing. Thus, SBDC recommends that you exhaust all other possibilities, i.e., banks, credit unions, family, friends, etc., and that you take the smallest possible advance to meet your most important living needs, i.e., housing, food, clothing, medical treatment, etc., and/or any additional legal services

Q. Will my credit affect my ability to get a cash advance?


A. No. Advances of money to you are based solely on the facts of your case.


Q. Are there any up-front costs to me?

A. It costs nothing to request an advance. After you submit your request and your attorney provides the necessary information, your case is evaluated. If you are approved for an advance, there are fees charged to you that are paid to the funding source only if your case is successful. If you receive an advance, we file a lien on your case with your attorney, which means that if there is a recovery, your attorney will repay to SBDC's funding source, from the recovery, the advance plus fees and additional costs as set forth in the Agreement. You and your attorney will be advised of all fees and costs prior to you accepting the advance.


Q. How, and when, do I receive the money?

A. Once the agreement has been signed, notarized and acknowledged by your attorney, a check is issued in your name and mailed via Federal Express, or other reliable delivery service, to your residence or your attorney's office. The check is sent immediately upon receipt of these documents.


Q. What do I pay if my case is successful?

A. The advance, plus all disclosed fees and costs included in the agreement, is paid to our funding source after a recovery in the case. It is like all other liens in the case and is paid prior to your receiving any portion of your settlement.


Q. If I lose, do I have to repay the advance?


A. No. You owe nothing if you lose your case. The advanced funds are absorbed as a loss and you keep the money already advanced to you.


Q. Why is this advance different from a loan?

A. Most conventional loans are recourse loans, which means that the money must be repaid on a monthly basis to the lender. With this type of advance, you only pay if you collect money from your case. All conventional loans have the following: 1) A specific time period when the money is due. This advance is completely contingent upon your case. Thus, there is no specific term of the advance. 2) Most loans require monthly payments. Since this is not a loan, it does not require monthly payments. 3) You are responsible to repay a conventional loan, regardless of whether the venture fails or you lack the funds. With this type of cash advance, you only pay if you collect money from your case.


Q. What's the difference between using my credit cards to pay my bills or getting a cash advance?

A. With your credit card, you must make monthly payments to the credit card company and you must pay them even if you lose your case. Although this type of cash advance f is more expensive than a credit card, there are no monthly payments and you only pay if you recover money in your case.


Q. May an attorney refer his/her client to SBDC?

A. Yes. In fact, many state bars have issued ethics opinions that permit an attorney to refer clients to funding companies that may provide cash advances. LINK

Q. Does SBDC handle Workman's Compensation cases?

A. Yes, but only when there is a third party. To be more specific: If you are at work and a piece of equipment you are using malfunctions, you would actually have two cases. One case would be a workman's comp claim against your employer and a second case against the manufacturer of the equipment that malfunctioned. Although we would not provide a cash advance against the workman's comp claim against your employer, we would review the third-party case against the manufacturer as a products liability claim. To be more specific: As long as there is another party (a third party other than the employer) we will review the case.
