What Are Structured Settlements?
A Structured Settlement is a method of paying damages to a plaintiff (the injured party) over a period of time when a lawsuit has been settled.

How Are Structured Settlements Created?
A structured settlement most commonly results from a personal injury lawsuit involving:

  • Product liability
  • Motor vehicle collisions
  • Wrongful death
  • Medical malpractice


When the outcome of a lawsuit results in a settlement, the damages awarded are funded in the form of an annuity contract issued by an insurance company. This settlement is structured as follows:

  • A company (typically an insurance company) is selected by the defendant to structure the settlement.
  • The structured settlement company purchases an annuity contract and sends the payments from the annuity to the plaintiff. The payments are fixed in time and amount.
  • The structured settlement company retains ownership of the annuity even though the plaintiff is the beneficiary.

Each year about 15,000 new structured settlement transactions are originated in the United States. This ever-growing number points to an estimated cash flow of $25 billion. A business note is a promissory note secured by a business and its assets.

How Are Business Notes Created?
Business notes are created when a business owner sells a business using seller financing. The note is secured by the business and its assets in case the buyer defaults.

Who Can Benefit from the Sale of Business Notes?
About 85 percent of all business sales involve seller financing. The seller will accept a cash down payment for part of the sale and a promissory note for the rest. Often the seller of the business involved wishes to move on to another venture or industry or may need money for expansion.

An automobile note is a promissory note secured by an automobile. Typically, multiple automobile notes are packaged together and sold as a portfolio.

How Are Automobile Notes Created?
When individuals purchase new or used vehicles and they require financing, they qualify based on their credit worthiness. Individuals that do not fall into the "best" credit tier (as a result of slow pay, no pay, bankruptcy, etc.) are called sub-prime customers who must obtain financing through dealers, private investors, or specialized financing companies.
